In the waning days of the Biden administration, the U.S. Citizenship and Immigration Services (USCIS) extended the designation of El Salvador, Venezuela, Ukraine, and Sudan for Temporary Protected Status (TPS) for an additional 18 months.
The TPS extensions are as follows:
- El Salvador – March 10, 2025 to September 9, 2026
- Venezuela – April 3, 2025 to October 2, 2026
- Ukraine – April 20, 2025 to October 19, 2026
- Sudan – April 20, 2025 to October 19, 2026
Individuals from these countries who are currently TPS beneficiaries in the United States may re-register for an additional 18 months of TPS during the designated registration periods.
What it means for employers? With the extension of TPS, qualifying individuals from El Salvador, Venezuela, Ukraine, and Sudan will be able to re-register for TPS. They will also qualify for an automatic extension of employment authorization and can file for a new employment authorization document valid to the expiration of the TPS period for their country.
The automatic extensions are as follows:
- El Salvador – automatic extension to March 9, 2026
- Venezuela – automatic extension to April 2, 2026
- Ukraine – automatic extension to April 19, 2026
- Sudan – automatic extension to April 19, 2026
Individuals who timely file a Form I-765 application for employment authorization may also qualify for an automatic extension of work authorization for 540 days, with the understanding that the automatic extension period cannot exceed the expiration of TPS for the individual’s country.
